General Terms and Conditions (T&C)

1 Scope of application
These general terms and conditions apply to all legal transactions concluded via the online shop of www.calarook.ch.

2 Conclusion and storage of the contract text
The contract is concluded with Calarook.
The presentation and description of the goods on the website www.calarook.ch does not constitute an offer of contract.
By ordering a product by clicking on the button „order with costs“ at the end of the ordering process, a customer makes a binding offer to conclude a contract of sale. The conclusion of a contract is only concluded when Calarook sends an order confirmation by e-mail.
The text of the contract is saved when ordering. Customers will receive an e-mail with the order data and the applicable terms and conditions. After conclusion of the contract, the order data can no longer be viewed online.

3 Payment
The statutory value added tax and other price components are included in the prices quoted. Shipping costs are not included in the displayed price and will be charged additionally. These are calculated based on the size of the package and the delivery address. The packages are sent by the Swiss Post. There is an additional charge of CHF 1.00 for packaging. If partial deliveries are desired, this will be charged per package.

4 Delivery, delivery restrictions
The package will be handed over to the delivery service within 7 working days – unless the description of a selected product explicitly states otherwise.
This period begins on the day of receipt of payment.

5 Change or cancellation of the order
Calarook may accept or reject changes or cancellations of an order at its sole discretion.

6 Transfer of Risk
The risk of accidental deterioration or accidental loss of the goods is with Calarook until the goods are handed over to the delivery service and is transferred to the customer upon delivery.

7 Retention of title
Calarook reserves the right of ownership of the goods until the purchase price has been received in full.

8 Warranty
The statutory warranty regulations apply.

9 Place of jurisdiction
The place of jurisdiction is Winterthur, Switzerland.

1 Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Rechtsgeschäfte, die über den Onlineshop von www.calarook.ch abgeschlossen werden.

2 Vertragsschluss und Speicherung des Vertragstextes
Der Vertrag kommt mit Calarook zustande.
Die Vorstellung und Beschreibung der Waren auf der Internetseite www.calarook.ch stellt kein Vertragsangebot dar.
Mit der Bestellung einer Ware durch einen Klick auf den Button „kostenpflichtig bestellen“ am Ende des Bestellvorgangs gibt ein Kunde ein verbindliches Angebot auf einen Kaufvertragsabschluss ab. Erst mit dem Versand einer Auftragsbestätigung per E-Mail durch Calarook kommt der Vertragsschluss zustande.
Der Vertragstext wird bei Bestellungen gespeichert. Kunden erhalten eine E-Mail mit den Bestelldaten und den geltenden AGB. Nach Vertragsschluss sind die Bestelldaten nicht mehr online einsehbar.

3 Zahlung
Die gesetzliche Mehrwertsteuer sowie weitere Preisbestandteile sind in den angegebenen Preisen inbegriffen. Versandkosten sind nicht im angezeigten Preis enthalten und fallen zusätzlich an. Diese werden anhand der Grösse des Pakets und der Lieferadresse berechnet. Die Pakete werden mit der Schweizer Post versendet. Hinzu kommen CHF 1.00 für die Verpackung. Bei gewünschten Teillieferungen wird dies pro Paket verrechnet.

4 Lieferung, Lieferungsbeschränkungen
Das Paket wird – sofern die Beschreibung eines gewählten Produkts nicht explizit Abweichendes festlegt – innerhalb von 7 Werktagen dem Lieferdienst übergeben.
Diese Frist beginnt am Tag des Zahlungseingangs.

5 Änderung oder Stornierung der Bestellung
Änderungen oder Stornierungen einer Bestellung kann Calarook nach eigenem Ermessen akzeptieren oder ablehnen.

6 Gefahrenübergang
Das Risiko einer zufälligen Verschlechterung oder einem zufälligen Verlust der Ware liegt bis zur Übergabe der Ware an den Lieferdienst bei Calarook und geht mit der Übergabe auf den Kunden über.

7 Eigentumsvorbehalt
Bis zum vollständigen Empfang des Kaufpreises behält sich Calarook das Eigentum an der Ware vor.

8 Gewährleistung
Die gesetzlichen Gewährleistungsregelungen gelten.

9 Gerichtsstand
Der Gerichtsstand ist Winterthur, Schweiz.
